What A Homes Association Can and Cannot Do:There are some misconceptions about the authority that a homes association has. A homes association can only enforce its bylaws and restrictions. If a homeowner is out of compliance with a restriction, any other homeowner can take action against the offending home. Usually this can be handled in a neighborly fashion, but in rare instances, cases have gone to court. Homes associations do NOT have any authority over city code violations. If you have concerns with an animal problem, you should call KC Animal Control at 513-9800. They will answer all your questions and take care of the situation. If you have a concern over code violations like cars parked on the street or in a yard, peeling paint, hanging gutters, trash, weeds or tall grass, please call the Neighborhood Preservation number at 513-9000. We have a Codes Enforcement Officer right in the Trailside Center. If you ask, they will even send you an "Action Letter" describing the disposition of the case. Remember, the homes association board members cannot enforce city ordinances. They are an all-volunteer staff who devote their own personal time to keeping our neighborhood the great place that it is.HistoryIn 1963 approximately 90 acres was purchased for the first development of Linden Hill known as Plat I. Plat I included 140 homes and duplexes. The eastern boundary is Winslow Place , the western and northern boundary is Queen's Place, and the southern boundary is 99th Street. Around 1965-68 an additional area was created from land purchased from James and Anna Wright for Plat II. This includes the duplexes on the south side of Mews Drive to 99th Street and Shepherds Drive on the east to Colony Place on the West. There are 137 homes and duplexes in Plat II. To preserve the quality and high standards, the restrictions & homes association declarations were created. In 1989 those declarations were rewritten and approved and now will extend as long as the existence of the Linden Hill Homes Association.
